Have you ever actually asserted the claim? That would be the minimum. And from that moment on, it doesn't really matter whether the responsible party has to pay their "penalty" monthly right away or whether it's offset against any claims. On the contrary, everything that has already been paid is clearly offset as well. I would therefore assert this contractual penalty retroactively from now on.

No, not directly. I thought that with a contract with a fixed completion date, the developer is automatically in default if the date is exceeded. Isn't that correct?

Well, you are quite the sweetheart (or rather, I probably should have scrolled back properly earlier). Earlier, it seemed to me as if the developer was unquestionably in default and had long since acknowledged the consequences for him, namely to cover your replacement apartment costs. Now, looking back, it appears that the construction delay is apparently due to the start of construction being overdue for more than a year. Accordingly, you should have noticed the lack of installment demands for ages, indicating that nothing is progressing. Has the developer been writing his amusing emails all along from the palm beach of a non-extraditable country???

I therefore take back everything I said earlier. Upon closer examination, this thriller reads to me as if, apart from a first installment on a specifically named apartment in a pipe dream, no progress whatsoever has been made. Could it be that the "delays in the building permit" stem from the deposits being squandered in a brothel or casino, and the building authority isn’t even touching the file without fee payment?

Check the insolvency announcements and discuss with your lawyer accordingly possibly the topics of "criminal complaint for fraud" or "third party petition" (in insolvency proceedings). I see your problem least in any hostile prices for inspections. Or did you withhold "something" in your latest update today, and there have already been noticeable advances and only the readiness for occupancy is still pending?

do you still want to move in there? In your finance thread, I had read that you are currently keeping an eye out for a larger apartment or house?

Oh, that came across wrong, sorry. There definitely are progress: meanwhile, the shell is almost finished and the roof should be erected this week. The civil engineering started last year (May) in early summer. Last month, we also had the first owners' meeting regarding the vote on installing a photovoltaic system. The planned completion date is Q1/2024.



We are currently still planning to move in but are keeping an eye open nevertheless. When I bought the apartment, there was absolutely no supply in the region where we are — due to the interest rate increase, prices have not yet fallen but at least there is now some selection, so we are looking around.

I can confirm that as well.. normally no or hardly any offers, now quite a few, but so far I have not noticed a downward price adjustment for houses. The only thing I notice is that condominiums sell very quickly again. There seems to be more demand there, perhaps. That might help you too, if you do end up finding a house.
