Is it a freelance architect and are the trades being contracted separately by you?
Which service phases of the architect according to HOAI have you commissioned?

You speak of cost estimation, that would still be in phase 2 and can only be a very rough estimate, as the execution is only roughly outlined. In phases 3 and 7 there are calculations.

To which phase does the difference now refer?

You speak of preliminary planning and specifications, but these are only created in phase 6.

Unfortunately, the additional costs are not only €3000! If that were the case, I wouldn't be writing here. The difference is that in the old bill of quantities (LV) a garage was included, but in the new LV for the contract for work it is no longer included. Furthermore, the windows, doors & co are also missing (as previously mentioned).

In other words:

Previously (Aug 2013): LV was prepared for a single-family house & solid garage. Based on the preliminary plans, a cost estimate was created. The title/building was always a single-family house with solid garage.



If I understand correctly, according to HOAI first a cost estimate is created and only later an LV??

In our case, we received an LV (Aug 2013) after our first preliminary planning. This LV is also not the one contained in the current contract for work.

The cost estimate was created in Oct 2013. If one has always planned the construction drawings, LV of the preliminary planning, in applications and discussions, you cannot simply leave out the garage in the cost estimate, can you? The LV from Aug 2013 also includes floor coverings, interior doors, etc. This LV is also quite concrete and not just a one-page rough LV...

I'll do it with concrete values:

Cost estimate (complete building)

KG 300: approx. €148,000 (building)
KG 400: approx. €28,000 (technical systems)
KG 700: approx. €11,000 (planning, incidental costs)

Contract for work:

only contains the building without technical systems (electrical, heating & sanitary, windows & doors, floors)

Therefore, it should correspond to KG 300, whereby the KG 300 should also include exterior windows & exterior doors and floor coverings. If I'm wrong, please correct me.

Price: €151,000 (so €3000 more expensive and then some trades were cut)

Hopefully, our situation is now a bit clearer

- For us, there is actually only one architectural firm and no "house construction company." The architect is our only contact person and also prepares the contract for work. The architect did the preliminary planning with us, accompanied us during the building permit process, and will also continue to accompany us during the construction.

- The bill of quantities from 2013 is already very specific and resembles that of the contract for work.

- Regarding the 2%...

My calculation looks as follows...

BoQ 2013 --> KG 300 approx. €150,000 --> 2% is €3,000

BUT!!!!

Windows & Co were still included there.

And if I, as a layman who can add one and one, roughly calculate and subtract it from the 2013 BoQ, then I can safely deduct €20,000 and that might not even be enough. (see missing trades)

Thus, the BoQ from the contract for work should be €150,000 - €20,000 = €130,000 plus 2%, i.e. €132,600. Then I would be satisfied with the price and would not complain.

Final inquiry: You probably signed a contract with whoever. If in written form, on page 1 at the top it says what kind of contract it is. Inside is the scope of services, and next to your signature the signature of the contracting party. Does page 1 say "architectural contract" or what does it say there? Does the description mention service phases according to HOAI? If yes, which phases? Is there a stamp with a number from the architect in the architects' chamber next to your contracting party's signature? (do not state the number, just yes or no) Regards WD

There is no "main contract" that includes everything. We have concluded a planning contract. This includes performance levels 1-4. Furthermore, we have concluded a contract for the design of the supporting structures / statics. We asked several times back then and he said that the costs should remain as they are. We suspect that he then lists the "construction supervision costs" as an item in the contract for work, which we have not seen in the draft of the contract for work.

The documents for the building application were signed by a planner / graduate engineer authorized to prepare construction documents, who was commissioned by him and also has a registration number on the stamp. Is that what you mean?

I believe we still do not know how you are building. Who owes you the house? Are individual trades awarded? A contract for work and services means that a work = house is owed to you. Is the architect then the contractor, since he concluded the contract for work and services with you?
If the architect only plans, then he cannot guarantee costs either, since YOU hire the individual craftsmen (after tendering by the architect). What is not clear to me with you is 1. how you are building and 2. what really your problem is (because of 1.).
