Carport roof and too long boundary construction

Yes, it is passable and could therefore be considered a carport. Only the areas A4 and A5 are marked as setback areas in the site plan (see picture in the first post). These are probably the setback areas of the neighboring house wall. Our garage is planned 3.02m from the property boundary. The canopy would protrude 36cm into the associated setback area (see also picture from post 1). I am also curious about the outcome.

It will be noticed at the latest during the inspection. Then the building permit could possibly be revoked retroactively, as it was issued based on incorrect construction documents.

In my opinion, this plan is incorrect, as either the carport or the garage/shed would have to trigger its own clearance area since the 9m limit is exceeded. I am surprised that the surveyor pointed out the violation but still drew it this way.

What I cannot understand is the division of the clearance area into A4 and A5, whereas no (clearance area) is shown in place of the canopy. The house wall should actually generate a continuous clearance area at that point.

Shouldn't the illegal construction be removed rather than the building permit being revoked?

Well, it will probably come down to the chicken or egg question and possibly to a right to subsequent legalization, but that's just a guess. However, that doesn't change the fact that incorrect construction documents were submitted for the assessment of the construction project – THEREFORE the permit is void... Are you sure that there are no encumbrances or any agreements? Because it is strange that different setback areas are indicated for a straight wall.
