Yes, I still had to give the surveying office a power of attorney to inspect the building encumbrances for the property. The letter and invoice for this from the building authority also arrived with me. According to their information, there are no entries in the register of building encumbrances.

Who drew the clearance areas? Are they shown like this in the cadastre or were they drawn by your planning office?

The spacing areas of the existing buildings were drawn in by the surveying office that created the site plan and provided it to the planning office. In coordination between the surveying office and the planning office, the house and garage including their spacing areas were then drawn into the final plan by the surveying office.

Alright, then we don't need to worry about whether the shared setback area means anything. If I were you, I would definitely find out now what was approved. Either through the cadastral excerpt or alternatively through the online geoportal of your federal state. Only two of the three buildings should be marked there.

It is becoming more and more mysterious. In the cadastral extract and in the geoportal, there are no buildings (not even the main house) shown on the property, although it has been developed for at least 15 years. For other properties nearby that have only been developed in the last 2-3 years, the buildings are shown both in the cadastral extract and in the geoportal.

I think now would be the time to consult a construction law expert and get advice. I wouldn’t just look for a pure specialist who can tell you what is legal and what isn’t, but also someone capable of advising you on the best way to proceed in this case to avoid getting into further trouble.
