I am a bit confused because apparently NRW changed the definition of the stepped story in 2017. I was hoping for an answer from along the lines of: "there is always some stepping allowed."

... but not at a building height of 5.50m. The urban planners want unequivocally single-story flat-roofed bungalows in this area to achieve a seamless transition to the open landscape. Maybe they should have limited the maximum height to 4.50m; then no one would have come up with the idea of a second living level. Any attempt to circumvent this urban planning concept will face strong resistance, even if a planner manages to exploit possible gaps in the development plan with imaginative designs. There is also something against digging in (Section III of the textual provisions): In order to ensure the structural precaution against flooding and waterlogging within buildings, all openings in buildings and external building parts, through which water can enter buildings (e.g. house entrances, external cellar stairs, windows, light wells, garages) must be at least 20 cm above ground level. If I understand correctly, the development plan is not yet legally binding. Has it even been publicly accessible yet? Maybe suggestions or concerns can still be raised. Maybe it won't even remain with the planned provisions.

I think if the city actively markets the plots, then it should already be legally binding, right?! I think I will try the gallery idea. Then somehow ground floor height 2.50 and gallery ceiling height 2.30. Then you would have 70cm left for the rest. Maybe the ground floor could be 2.30m and through the gallery you would have a high ceiling towards the back, in the direction of the dining and living area, which makes the room less oppressive.

You can move into a gallery in a modern way by making utility rooms a bit smaller and possibly working with wooden studs. Living areas open to above. Bedrooms can also handle 2.40. We don’t know how many people the project is supposed to accommodate, but it will be exciting. Would you like to be involved? With photos and beforehand the floor plan discussion?

There is no connection: plots are also marketed before development, so why not also before legal validity? - otherwise, plots in §34 areas would not be sold ...

Room height 230 cm ... but you should also check whether there are minimum requirements for living spaces. How tall are you guys? And, with something like this, you might also need to consider the alignment of window recesses etc. Also possibly planned use of roller shutters.
