When are buyers of rented apartments entitled to rental income?

So, in our notarized contract, the exact date of the transfer of burdens and risks was stated, that MUST be included. That is the date from which the rent is owed to you. Whether you are then registered in the land register is irrelevant (transfer of ownership). And the day of payment has nothing to do with this either. We had the transfer of burdens on the 21st, the payment took place in two installments on the following 1st and on the 25th of the next month, and the transfer of ownership was then sometime 3 months later. The decisive factor is the transfer of burdens (and benefits) recorded in the contract.

most of the time the day of transfer of risk is also the day of payment, or shortly after upon delivery. whoever is listed in the land register is secondary. asking the notary is basically the only right option. ps: and real estate cannot be sold without a purchase contract. that is exactly what the notary does

But why is it that when the transfer of risk becomes effective immediately upon payment, the right to terminate for personal use is only permitted after registration in the land register?

Because personal use can only be claimed by the owner. And one only becomes the owner after entry in the land register. However, the transfer of benefits has nothing to do with ownership and can be freely negotiated contractually.

Normally, as Payday (hi!) writes, the rent belongs to the buyer from the moment of purchase price payment. There are certainly other scenarios, but that was not the question here.

I am waiting for the day when I hear from somewhere that someone, trusting in these "I am just an amateur" and "not allowed to give legal advice" statements, suffers real financial disadvantages from such information. I really rarely read such collections of rubbish.
