Rent for construction dryer in final invoice/builder - legal?

Hello,

yes, the site manager had asked us in advance about the circulation and we had decided against it because of the risk of legionella and the higher operating and acquisition costs. Of course, it is not bad now that we have it. The question is whether it can be easily removed again if we do not want it.

to 1) The passage clearly states that you pay the costs for the heatingSYSTEM. So everything. That includes the rent. Otherwise, it would have to say that the heatingOPERATION, electricity costs, or similar are your responsibility. I like Mottenhausen’s trick, maybe the 700€ can be reduced a bit more. I don’t know what a common rental fee would be.

to 2) What does the contract say? Is there written communication about it? Removing the circulation is no longer possible, but maybe the pipe can be decommissioned and the pump in the basement removed. Another technical question: How many meters is the hot water pipe without circulation, or how many liters have to flow before it gets warm?

to 3) Which areas and amounts are involved?

You generally cannot simply shut down a circulation that easily. The worst case in terms of hygiene is when dead sections or corners are created where water stands but were originally designed for flow; I wouldn’t just do that, as it greatly increases the risk of Legionella, for example.
