And if the tenant simply remains in the apartment after the end of the lease and no one asks them to leave, a new lease could very quickly be tacitly created.

you can only express opinions. nothing more, nothing less. even lawyers talk a lot of nonsense to get the job. the only one who is right is the judge at the verdict, since his decision counts (an appeal is of course possible depending on the case).

Furthermore, lawyers are actually the biggest liars of all. in almost every letter that a lawyer sends on behalf of a company/private person to someone else, there are lies and false assumptions to put the recipient under pressure and, for example, make them pay or admit something. if lawyers send warnings for false claims, lawyers should actually also be allowed to receive warnings for their fairy tales. it would actually be a great financing model, since EVERY letter is a lie, as pressure is exerted through lies. for me, everything is a lie that does not directly correspond to the truth. deliberately leaving out details is also lying, for example...

I also said "could". If the old tenant was not given notice (which was the case here), they theoretically have to vacate the apartment. Of course, the new owner is free to take over the old tenant if they wish. That is desired here, and the tenant probably has no objection either. The tenant gives the impression that they want to stay (otherwise they would already be gone).
