But that's how it is. I signed the contract with the developer, who employs an architect. I was then able to choose a contractor from several offered by the developer, who will build my house turnkey. I do not want to disclose the name of the developer at the moment.

My opinion is, you planned sloppily or communicated your wish list poorly. Now the other person is supposed to get the blame, especially since it now costs something. Before the building application, this must be clear. He told you that the 3 m limit can only be done this way if the house is deeper. You should have said back then that you don't want that, what else is possible?

Your feedback is important to me in order to be able to assess this. "He told you that it can only be done with the 3m limit if the house is lower." He did not say that. He gave an initial consultation in which it was roughly determined where the garage should be located.

A drawing would explain a lot better :) I think you have a contract with a GÜ. Since the property belongs to you, there is no developer! Everything that needs to be clarified goes through the GÜ and not through his employees or contracted subs, even if it is an architect who creates the plans for you. Your contracting partner is the GÜ!

Our case is similar. Own property, construction with a general contractor. The boss has a planner who makes construction drawings and an external structural engineer. The boss is authorized to submit documents to the building authority as an engineer. After the last conversation and handshake in his office, we received all the drawings as PDFs, we said yes, that’s how we discussed it, the general contractor then completed the building application, we went to his office and checked it again, including site plan, elevations, etc. The structural analysis was also included, although I don’t understand it, the Excels must be correct, we’re not building the Elbphilharmonie, and then we signed three copies. One for me, one for the city, and one for the district. With these, I then went to the city building authority, submitted them, they put their okay stamp on it in my presence, off to the district, three weeks later the permit plus fee notice arrived. And now we are bound by that. That’s how it is. Honestly, was it very different in your case?

YPG, sorry that I am not very knowledgeable in legal matters, the property already belonged to me before the contract was signed. Then it seems that the status of my contractual partner is that of a GÜ. I will now also contact him. Attached is a small drawing. Nordlys, okay, I have to submit a new building application, there are additional costs, but that is still the lesser evil for me compared to the fact that the house would be 75 cm lower in the long run.
