Tricky land planning: Garage + entrance towards SW or NE?

As mentioned at the beginning, we have only planned with "Variant 1" so far. Meanwhile, we like "Variant 2" more and more, so we will plan accordingly. The week after next we have the first appointment with the architect. If there are initial drafts, I will gladly post them here. 130 m² would indeed be very tight. But the plot ratio = 0.4 is also stated in the plan. So can I assume that? Can a development plan actually be worsened after the publication of the legally binding version, for example by removing the plot ratio = 0.4 so that only the footprint = 130 applies? Isn't a development plan created by experts? If your statement is true, is the development plan invalid in this form or can one choose the "more favorable variant"?

It’s good that surveyors look precisely, otherwise you might as well just hire a rough estimator.


Oh, an architect too – this just gets better and better. Now make my Sunday even sweeter and tell me that he seriously is going to make a first draft and not just trace a free software simulation house he brought along.


Later versions may always also be different in a negative way if necessary, but unfavorable interpretations of existing regulations would not be lawful.

Here the information is really unusually unclear. The interpretation "0.4, at worst but 130 sqm" would be nice – but I see no indication that this was the intention.


No, I do not see any option to choose. These plans are created by experts, but there are several levels of quality. Increasingly, external planning offices are engaged, and these sometimes also use working students – you can usually see this in eaves heights that only "work" on one side of the street in slope situations and similar details. Behind this floor area ratio – floor plan regulation, however, there is probably a thought that unfortunately was not explained (and as suspected, was probably also poorly measured against the valid standard).

That is exactly the question.
I still maintain that the regulations are confusing and inadmissible, but I think you understood them as the plan providers intended. Floor plan for the main facilities, which also include conservatories, terraces, and balconies, and floor area ratio for everything, including the permissible exceedances according to §19 (4) Building Use Ordinance. Therefore, your current planning should not be a problem.

Only with an official amendment, i.e. a change resolution by the municipal council, public display, citizen participation, and statute resolution. Very elaborate, therefore very unpopular, hence unlikely. Unless someone sues against the development plan. If a court finds significant defects, the development plan could be void.

I am now of the opinion that I see problems that are not really there.
