Subcontract before purchasing the property?

We are going to the building authority again this afternoon - we will address the points there. Thanks for the hint. We will contribute 20% equity - let's see how long that will last or how fast the land registry office is.

If the land purchase is basically okay (from the municipality's side), and the notary appointment is just "formal," I see no problem with the contract with the house builder. Of course, it will then take a while longer until everything is recorded in the land register. That only happens once a) the land is paid for; b) the tax office issues the property transfer tax assessment, and c) you have paid the invoice delivered by assessment. The property transfer tax assessment alone sometimes takes "forever." I then called there and was practically "moved up." Nevertheless, from the notary appointment to the land register entry it easily took 5 months..... (and we always paid everything immediately).

But is the registration of the mortgage in favor of the bank really necessary for the disbursement of the loan? Without money from the bank, I can't pay for my property.

The bank accepts an AV; the transfer of ownership is not required. The AV is done in a few days.


Sort of. The bank requires security. This can be the registration of the mortgage or (if it has to go very quickly) a priority certificate from the notary. This is practically immediate but costs a few euros.

I would, if the purchase is just a formality now, also sign the construction contract in advance. There is nothing against that.

I just checked again, yes, that’s what I meant too. The pre-registration of conveyance took nearly 3 months and only because we started pushing after 2 months... But as mentioned, that can vary a lot.

Edit: We were recorded in the land register after 11 months, but I think that didn’t matter anymore.

edit2: About 4 months after financing, we had the notification in the mailbox that the bank was registered and we could draw the money.

According to the building authority, the land register entry in Ba-Wü is carried out online. Therefore, they assume that this will be registered within the four-week payment term for the purchase price of the property and that the disbursement of the loan can thus be started promptly.
