Sidewalk damaged - Who is liable?

An insurance company is generally liable for the mistakes of the policyholder. Intent or gross negligence is rather unlikely.

I do not entirely share that opinion. It could quite possibly be interpreted as gross negligence.

The inquiry with the insurance will clarify it. Anyone driving bulldozers and 40-ton trucks over sidewalks can imagine what will happen.

I see it differently. When it comes to a sidewalk, distinguishing between half-broken, three-quarters broken, and completely broken simply makes no sense. I suspect from a legal standpoint there are only two defined conditions here: "intact" and "broken." Since it was demonstrably (photos) already broken beforehand, no further damage resulted from the driving. The municipality will probably have to bear the cost of the renovation itself, but they can let the project run wild and possibly recoup some costs through resident contributions, which in the end will be more expensive than if you simply have the sidewalk quickly redone yourself before it all escalates.

My suggestion would be: don’t hesitate: debris container, everything in, construction crew Bulgarians, compact & pave. As fast as possible, before more detailed claims are formulated by the municipality.

Only the group of Bulgarians will probably not be a certified construction company. Apparently, the municipality has already formulated detailed requirements. Maybe try to find out what amount is involved?

And especially if they already have a defect. One should have been more careful or have gone straight to the municipality to discuss and reach an agreement.
