Sidewalk damaged - Who is liable?

If a construction site has to be accessed via a sidewalk, appropriate safety measures are required. If the damage was knowingly accepted, this is anything but an insurance claim.

Wouldn't we rather leave such judgments to the insurance? And possibly to a lawyer?

You didn't understand that. What is the OP supposed to do with your statement that this is definitely not an insurance case? Troll, not report to the insurer, withdraw the submitted application with a mea culpa or what? One can also say: Possibly expect that the insurer will reject due to xy reasons. That sounds much less accusatory. Karsten

Oh Nordlys. Just read the thread again in chronological order.

The gentleness you desired was the subject of my first response. Another user then reacted, saying this was a very typical insurance claim. The OP was pleased, that was probably what he wanted to hear. After that, I became more direct.

The OP should mentally prepare himself to at least bear most of the damage himself. The damage was avoidable and foreseeable. That is his responsibility as the builder. He can now ask the insurer, of course, trial makes wise. But I wouldn’t expect much from it.
