"Replacement construction" of a fence no longer permitted according to the development plan

You will need a 35m construction access? Isn’t that excessive? Even if it’s really necessary. Then I wouldn’t do anything there except maybe hide the ugliness from my eyes with reeds, bamboo, or willows. But if you absolutely want to put something new there, you will have to build at least a similar structure, like a wooden plank fence, or comply with the development plan.

That would certainly be exaggerated. That’s why it won’t happen.
But: Currently, the "bulwark" is on the side of the property that will later be the development side. Our front yard will eventually be bordered neither by a wooden bulwark nor by a double rod mat fence or a tall hedge. Therefore, any tall privacy structure that is there at that time will be removed. That’s what the development plan requires and that’s also what we want.


I don’t necessarily want to. However, the condition of the existing structure determines what I will ultimately do. If a replacement is only possible one-to-one anyway, then the evaluation shifts in favor of the existing structure and the necessary repair work for it. If it had been somewhat more flexible, with more room for design, I would have considered another solution.

In the end, it’s important to me that the property looks well cared for and tidy. I don’t want the impression to arise that it’s abandoned and gradually deteriorating. If the period between purchase and development were limited to one year, this question wouldn’t even arise – but with the planned timeframe of 3-4 years, it’s different for me.

Only thuja is missing. :rolleyes: I consider that wishful thinking and somewhere a bit of a lie. Nobody builds a fence that they will tear down again in 4 years just so the property does not look abandoned. Or do you have too much money to throw away like that? Basically, I only know of protection of existing rights for existing structures. If you tear it down, the protection is gone and the development plan applies. The question is whether replacing the slats would count as a repair. It should, as long as the fence does not differ in essence (height, color, material, appearance, etc.). However, if nothing of the old fence remains, it will be hard to have this accepted as a repair. Especially since the city is already watching your fence like a hawk.

May I ask what you find rude about it? Is it the "ugly" that personally and taste-wise offends you or your idea? I don’t find "shabby" exactly more polite when it comes to environmentally friendly treatments. Even these thoughts of yours could be considered "shabby"... if they’re not even that.
