Hello Escroda,

the regulations change in the southern area. I have expanded the graphic in the attachment a bit. According to the legend, 0/20 stands for open construction and a maximum building length of 20m.

Floor area ratio means floor planand arearatio. The floor area ratio indicates how many sqm of floor space are allowed to be built per sqm of property area, so in your case 30% of the property area.

Calculation: 780 x 30 ./ 100 = 234 sqm

The floor spaceindex (floor space index) indicates how many sqm of floor space are allowed per sqm of property area.

Calculation: 780 x 0.35 = 273 sqm as well as 780 x 0.45 = 351 sqm gross floor area (GFA; the area is measured according to the external dimensions of a building).

This means that you may build a one-story building with a maximum gross floor area of 273 or 351 sqm on 234 of 780 sqm of your property. Based on the other information in the development plan, you can build a wonderful single-family house. So where is your problem?

Hello,

the problem is that according to the legend, the development plan sets a floor area ratio of at least 0.35.

The floor area must therefore be at least 273 sqm. Dutch states that the development plan is from 1994. Assuming that there are not four years between public display and legal validity, the 1990 Land Use Ordinance applies. According to it, the floor area is to be determined based on the external dimensions on all full floors. Habitable rooms on other floors are only to be included if the development plan explicitly stipulates this, which Dutch denies. The minimum floor area of 273 sqm is opposed by a maximum footprint of 234 sqm for the stipulated single-storey construction method.

Without knowledge of the legally binding development plan with textual stipulations, this contradiction cannot, in my opinion, be clarified. Therefore, my recommendation is to ask the planning authorities at the municipality directly how the specifications are to be understood.

In case of clarification, I would also appreciate feedback, one never stops learning.

With a floor area ratio of at least 0.35, the one-story building would have to have a minimum size of 273 sqm. Apart from the fact that it would be too large a single-family house for me, the size contradicts the site coverage ratio of maximum 0.3, which may only be 234 sqm at most. According to the development plan, nothing should be built at all. Somehow I must have a flaw in my reasoning; I cannot imagine that someone would plan such nonsense...

You are confusing buildable area (floor area ratio) with the total living area of the ground floor combined with the upper floor/attic (plot ratio). A few square meters also add up in the attic.
