Painting basement walls from the outside???

Hello,

our basement is now finished and the ground floor is being built.

When I was on the construction site recently, I saw that the construction workers – contrary to the agreement with the architect – did not apply the 'black paste' to the area on the outside of the basement wall where the spacers for the formwork were. The openings were all sealed with plugs. Sorry, I simply don't know the technical terms. After I addressed this with the construction workers and the architect, they are now in the process of correcting it. This did not lead to any cheers from the workers, as the basement insulation was already partly in place. But so far everything is fine.

Now the foundation for the garage has already been built up on one basement wall and filled with concrete. I documented with my photos that no 'paste' was applied here. Do you see this as critical, that this paste is missing here? I want to avoid getting water into the basement in a few months because of this and then having a very high effort necessary to correct it. Of course, at the expense of the builder.

It should be mentioned that the basement will always be in water, but not completely.

What else counts besides the contractually fixed agreement?
Are you sure about that? Having the right and getting the right are known to be two different things!
As an independent, external construction consultant not tied to sales, I would have triggered a construction and payment stop here, since this apparently represents a deviation from the plan!
Why client-paid planning/dimensioning if it is not adhered to during execution?
Have "fun" with that!

According to the statement (liegt schriftlich vor), in the event of damage, the additional expenses will be borne by the construction company (injection of compaction agent). So first wait and see what happens.
