Notary fees. Who should bear them?

Do you still rent yourselves?

Because if yes, then I would rather write a later date (e.g. the 01.09.17 or 01.10.17 you mentioned) into the contract, then you and the seller have planning security. What good is an earlier date (e.g. 01.07.17) to you if you can't move in yet, but you have agreed on a compensation payment with him in case of delay. Then you would still have to move out of your old apartment and have all the stress on your hands (storing furniture, hotel, whatever) for a few euros.

What are 2 months for your own house if you want it 100%. Financial concessions from the seller or not. I would ignore that.

At some point, however, one wants to know where one stands. You can agree on 1.9. as a date, and if it is not met, compensation should be paid, which is also absolutely common. The apartment is usually only given notice 3 months in advance anyway, so by then it is normally foreseeable whether it will work out for 1.9. The seller can secure himself with a completion date at his company. There really is no need to let any bad feelings arise now. The agent should do his job and mediate or contact the seller himself instead of playing stubborn. The question is, and you can assess that best, would a new buyer be found quickly at any time? An unofficial tip maybe via pm if you like...

So, I don’t want to burst anything. The whole thread started with how the notary fees are handled if the worst should happen. I would also agree to set the appointment for 01.09.2017. But so far I only see disadvantages. But why would anyone want to draft a notary contract without setting any dates with their builder? We have already adjusted our financing to 01.07. I really don’t feel like having 2-3 more appointments with the bank. That costs time and money. On top of that, we are still planning a wedding... Also, I don’t want my good terms at the bank to go to waste. There are not unlimited interest-free periods for preparations. We would have to pay interest for 3 months without having anything. And there is no concession, no insight, or apology from the seller... That annoys me. I just talked to the real estate agent again, and he now wants to talk to the seller.

Because the seller knows that if you don’t buy his house, someone else certainly will. That is the current market situation; unfortunately, you have to face that. And I suspect the seller is also frustrated that his new building is not progressing as planned. As an option: immediate transfer of ownership and the seller becomes your tenant. The notice period equals the notice period for your apartment. The purchase price is reduced by the rent up to August 31, which also saves you real estate transfer tax. In this arrangement, it can work out that everyone saves face and no one comes off worse.

Well, I wouldn’t come at it with the club of compensation payment. The notary contract already provides a separate clause for that. The seller is practically cornered by bringing up this compensation and feels overwhelmed to make a timely decision. And honestly: what are 500 or 1000 when you end up in a dream house ;) Cheers
