what exactly is the original terrain height? if I quickly dump 50 truckloads of soil on it before buying, do I then have a higher original height? if we really had to take our original height as a reference for our carport, we couldn’t even stand inside it. we would also like to have 3 meters for the roof height but only have 275 cm. that’s pretty little already, especially if you have to add 30-40 cm more to level the plot. if you then deduct another 40 cm for the roof + wooden construction, and another 20 cm slope over 9 meters length, you can no longer stand underneath, let alone park an SUV under it. ridiculous laws...

I pulled out the first draft and lo and behold: it was planned differently here than the final plan! I can't believe it! So is it an architect's mistake!? Because in the first plan, we wouldn't have a slope towards the garage or the house. Now I just have to explain this to the building authority without needing another new plan.

In the last photos, the house is also lower than the original ground level, right, or did I miss something?

If the excavation pit is already there, you would probably have to fill it again, which definitely costs money (usually not possible with the excavated material itself, as it does not compact well or only poorly - unless you have gravel soil). In addition, you have to consider that possibly existing terraces, etc., would also have to be filled up.

What speaks against the slope? With a channel in front of the garage and possibly in front of the front door (or nearby), the problem should be solved. It definitely comes cheaper than submitting a [Tektur] here - especially since no one here knows the development plan and can say whether the [Tektur] will be approved.

As a rule, it is the existing height before the next/upcoming/legally approved construction measure. Exceptions prove the rule.



Counter question: who would approve such a measure for you before the purchase? Nobody. Neither the building authority nor the owner. And why would you want to pile up soil on a property that you have not yet bought, ergo that is not yours yet?



Not at all.

It is of course possible to change the terrain height for a construction measure, but this is only possible to a limited extent without a building application. The legal basis does not stem from the pen of an official with a clown nose, but rather from the usual suspects (builders), whom I like to call "hammer throwers," i.e. people who first do something and then wonder that the neighbor and/or building authority does not like it.

Then it goes to court, a judge says that it is nonsense (which one could usually have guessed beforehand), and eventually this becomes a general legal norm. Moreover, in my personal assessment—regarding height specifications—25% of all building applications in Germany are at least faulty. In most cases this is unproblematic, but if not, five-figure sums are quickly due.

I am therefore still of the opinion that if this forum has a purpose, then it is to neutrally inform laypeople/ignorant people about such pitfalls.

I don't understand the reaction!

The topic is interesting after all, why is there no definitive solution from your side? Have you spoken to the architect about it? What was his statement on the planning?

PS: We also have a slope on our driveway leading to the house and I see it as a smaller problem than the height difference to the surrounding terrain.
