Payment schedule is more customer-friendly. However, I couldn’t negotiate at all due to time pressure.

Edit: Demolition removed, that is not done by the general contractor.

It also makes a difference whether it is a GÜ or GU, because the former ultimately has to take care of the entire issue of the building application.

In our case, the GU also handles that. For this, a planning contract is concluded beforehand with 5% of the total amount. This is then deducted later in the consumer contract. They also take care of the electricity, water, and gas connections.

It is exactly the same with us. A contract was first created for the planning and application services, which will be offset against a later construction project. If the construction contract does not come about, we have to pay the costs.

A silly question:
Is the general contractor according to §650m of the Construction Code not obliged that the final installment payment (in our case after acceptance) must not be less than 10% of the total amount? So, in our provider's case, the 5% for acceptance would not be legally compliant. Or am I seeing it wrong?

So does this now mean that you have to pay for the planning in advance? A planning contract was made with us, but the costs were not collected because the work contract was concluded within a deadline. (Die Planung lag allerdings auch nur bei eher symbolischen 1800,- EUR, schloss allerdings auch noch nicht den Bauantrag ein.)

Yes, I had to make the first installment payment at the start of the planning. But I didn't have much trouble having the architect draw numerous changes.

That's right, there was something. For me, the last installment is 10%.

Maybe the others are then simply allowed to withhold 5% from the others until the final acceptance.
