Is a gas boiler possible without solar?

hello,

we are currently building. solid construction, 36.5 Poroton, gas boiler, no external insulation and no ventilation system.

thus, we do not meet any KFW criteria. a solar system is planned in the building application. since I am not a fan of the solar system anyway and would also like to save about €5000, I am trying to do without the system. can I get around this? in order to comply with the Energy Saving Ordinance, it actually has to be installed. but my architect said that no one checks whether the thing is installed or not. we would provide all the lines etc., and if someone really missed the system, it could be installed at short notice. is there anything against this?

I have already spoken with other "experts". some said no problem, others said a fine threatened... the building authority would not check this, but the chimney sweep would... then I asked him... he would not check either...

so I really do not know what to expect. of course, I also do not want to do without the system and then pay a hefty fine in 10 years because it was checked somewhere.

now I could really tear myself and my architect apart

What is your question now? Should we advise you to deliberately disregard the requirements of the Energy Saving Ordinance in the hope that it goes unnoticed (regardless of whether/how the heating then possibly needs to be planned differently)?

If you do not take advantage of KFW funding, I personally see no moral problem in escaping the current eco-madness. Legally, of course, you are violating your building permit. What can happen there is uncertain. Around here, many people seem to do quite well by consistently ignoring building authority letters....

But you have already submitted the building application, so the old law still applies to you, right?

Do you have a chance for this 85% regulation? So 85% of the reference house?

Alternatively, you could get used/defective solar modules and screw them onto the roof. Whether water really flows through them cannot be seen from below...

You can waive the 15% share of renewable energies in the thermal protection certificate of the structural engineer for new buildings if, instead, as a compensatory measure, the transmission heat losses are reduced by 15% compared to the reference building, based on the current Energy Saving Ordinance 2016. The monolithic wall or the entire insulation concept must be able to achieve this mathematically and be demonstrated as proof according to § 10 Renewable Energies Heat Act (compensatory measures). Anything else is not legally compliant.

At our place, the compliance with the Energy Saving Ordinance was indeed checked by the building authority. And we achieved that only through the installed (!) solar system.

yes, the building permit is approved. the shell is already standing.

as I said... my architect said he knows many houses that were built like this. and retrofitting is always possible at any time anyway. and in his opinion our building authority would not check that...

a well-known architect said that it doesn't matter, as long as there is some kind of heat certificate on it. and if my architect makes that, I would be off the hook.

how can I reach these 15% without the aforementioned elements that were not built (ventilation system, external insulation, etc.).
