@TE: In reality, probably nothing will happen if you simply do not install a solar system. Hopefully, the building authority will have more important things to do than to check such petty stuff. Only if you have one of those super nitpickers/wannabe block wardens in your neighborhood who spend their free time checking whether their neighbors are properly separating their trash or if possibly a scrap of paper ended up in your yellow bag, you might get into trouble. And unfortunately, there are quite a few of those guys....
A stupid thought: If I understood correctly, during all chimney sweeper inspections, only the proper functioning/exhaust temperatures/exhaust values of the actual heating system are checked. So if you really just nail a solar thermal dummy to the roof, you should technically already have left the legal gray area towards legality...?
With that, you have installed a ST. That the thing must actually work is not stated anywhere, right?!? You are also allowed to turn off the circulation pump of your functioning solar thermal system and thus take it out of operation.
It is less problematic to just bite the bullet and throw the money for the ST out the window. Since you have to provide the pipes and the bivalent heat storage anyway, it’s not 5000 but probably only 3000 euros.
