Help needed - Real division of a narrow plot

The architects will collaborate with publicly appointed surveyors in the area. As mentioned, for a rough statement the publicly appointed surveyors only need a map with the planned new boundary and a rough design (building volume) of the house. They can get that from the AR or help each other out on a bike.

But yes, inviting them doesn’t hurt either; at least a site visit/photos would be appropriate in NRW given the described situation. If desired, I might be able to put you in touch, I studied in H and therefore know some publicly appointed surveyors in NDS/NordD.

Construction Documents Request at the Responsible Building Authority

I would like to request documents in writing from the responsible building authority and am unsure which documents must be provided to me or which I need. Can someone help me here?

- Local map (already available to us from the municipality)

- Development plan?
- Encumbrance register?
- ???

Save yourself the effort, specialist planners like architects and surveyors have online or telephone access to most data ...

And assuming there actually is a building encumbrance [Baulast] (which I almost rule out based on the information so far) - are you sure you could interpret the corresponding impacts on your construction project [BV] in a legally secure manner in every case?

Well, you can possibly build first and then do the partitioning for the in-laws ;)

Moreover, it should be considered: if the in-laws' house is suitable for families, why don't the in-laws build themselves a new - small, but age-appropriate house in the garden. That should be discussed by your wife with her parents - this would serve both parties. The in-laws get a suitable 'Stöckli' and buy the existing house and renovate it :)

That is then the "no-risk-no-fun" option. ;)

I don’t know exactly how this is handled in Switzerland, but in Germany you need a subdivision permit for developed properties. This can also be refused if the building regulation deficiencies resulting from the planned subdivision cannot be remedied.

Additionally, there may be further tax disadvantages.

Thanks for the tip but both suggestions are out of the question for us.

If anything, we will divide first and then build. My partner was at the building authority today, they are now obtaining the development plan which apparently does exist and where, for example, according to the gentleman, single-story is specified as a requirement. Otherwise apparently nothing, since the development plan dates from around 1955. Also, the gentleman on site said we have to adapt to the other houses in the area.

We had planned a city villa, which now obviously doesn't fit there, plus the fact that being single-story makes the house smaller. Is single-story already a dealbreaker here? :(
