Help needed - Real division of a narrow plot

Hello everyone, unfortunately I have not received a response to my aforementioned question. Maybe something will still come. :)

On the topic, we were at the municipality last week, a division/development is basically possible within a certain window and with the corresponding distances in [NDS]. Now we have made some progress, but I am unsure if I have chosen the right path from here, so I ask for an assessment.

My procedure plan:

1. Clarify details with the owners of the property regarding the division
2. Appointment with an architect to get a non-binding/free offer and to see at all what would be possible on this rather narrow property and whether we like it.
3. Think everything over calmly :)
4. With the architect’s planning, go to the responsible building authority and obtain written approval for the architect’s planning
5. Commission a surveying engineer (publicly appointed surveying engineer) for the property division

I hope this is the right way; if I have forgotten something or should do something differently, please let me know. :)

Hello ,

You may only be able to clarify details about the division with the parents-in-law once the architect and the publicly appointed surveyor have reviewed the construction project from their side. It is an interplay; it cannot be done otherwise, because you certainly will not recognize and/or specify some building regulation conditions.

The building application must also be submitted by the architect.

The division should at least be discussed with the surveyor beforehand and represented in the building application.

Well, the division is fixed and corresponds to the maximum we would get. More is simply not possible because of the garage, although we have already "upgraded" from 12/14x25.5m to about 14.75x25.5m. :)

In other words, if nothing proper is possible on the above-mentioned plot including the distances that must be observed according to NDS as per the architect, then the game is already over again. :/

oh yeah? A garage can, for example, be located in a distance area easement...

So - and exactly at this point I strongly recommend hiring a surveyor, because only they can fully inform you about the possibilities and alternatives. Especially if there is a solution outside the standard. Neither the layperson nor the architect knows about deviations from the standard. As a surveyor, you can tailor the division to fit the house planning and the needs of the parents-in-law - but this only works if you also know the planning and needs of the parents-in-law.

Above all - what are you missing out on? For the implementation of the building project, you need a surveyor anyway and any publicly appointed surveyor can explain to you in 15 minutes – legally secure – what is really possible and what is not.

Thanks Dirk, we are sitting together with the parents-in-law this week and then I suggest inviting the publicly appointed surveyor next. :)

Next week we have two appointments with architects.
