The construction schedule is void if the developer submits an additional claim that is not paid without comment.

Why do you think the lawyer advises a settlement? He doesn’t make money from that...

PS:
By the way, at the moment any delay can be justified with the keywords material shortage and shortage of craftsmen. The general contractor has received his money up to the current construction phase, he doesn’t mind if he doesn’t have to continue building.
Have you ever been through this yourself or are you just giving smart advice from the finished house?

The confusing thread history of even overwhelms my 11ant memory. But I recall that the sluggishness was on the client side in her case.

Two times no. On the one hand, a fairly designed clause also has to agree on the steepness of the increase when the estimated duration is exceeded. And regarding obtaining approvals, the general contractor differs from the subcontractor in that this is the client’s responsibility with the general contractor, which is thus naturally beyond the contractor’s influence.

It depends on what is stated in the contract. Many contracts, for example, use the construction cost index as a reference, which then naturally applies to everything. In this case, since nothing is agreed upon, the matter will go to court in case of doubt until a clear decision is made.

See my explanation in post #49: a tranche of the payment plan is not equivalent to a section of the performance that could be partially accepted or otherwise delineated in its value. The business precisely not breaking down into individual lots is part of the nature of building with a general contractor (and is typically an explicit wish of the client side).

That’s what I meant in my earlier post. Just with less fancy words. :D

Is that a fact? What is the reason for it?
