For the services to be provided under this contract, the client shall pay the contractor a lump sum according to the overview sheet page 1 including the statutory VAT applicable at the time of contract conclusion. In the event of changes in VAT, the lump sum price shall change accordingly. This does not apply to services which are to be rendered within four months after contract conclusion. 2. The contractor is bound to the lump sum price stated in no. 1) for the duration of 12 months from the conclusion of the contract. Delays for which the contractor is responsible shall not be taken into account when calculating the duration of the price binding period. If the client does not comply with the necessary cooperation actions within the duration of the price binding period, the rights and claims of the contractor shall be determined according to §§ 642, 643, 645 of the Building Code. 3. Additional costs, e.g. from special requests, as well as the review and approval costs of the building authority itself, are not included in the lump sum price. Then the installments in which the price is to be paid are listed. That is all that is stated regarding payment and price binding. For your information: two installments are still open.

Am I reading this wrong "Delays for which the contractor is responsible are not taken into account when calculating the duration of the price binding period." or is it supposed to mean that delays caused by the general contractor are not their problem? Sounds to me like an unfair disadvantage to the customer

What is still missing from the house when you say 90% finished? Terminating the contract and finishing it yourself is not an option with the money from the 2 installments?

It really does read as if it is not the general contractor’s problem.
Roof covering is missing, the last drywall and electrical work is missing the final step, tiles, and the heating is not there yet.

I don’t think cancelling is that easy?

Sure? I understand it exactly the other way around. But so far he is not responsible for any delay. I am only concerned about the increase. That it would be more was clear and already planned for. But €50,000 I find cheeky…
