We are now quite familiar with our current one and have also talked about it. He said everything had become immensely expensive. For him, a lot works because of available liquidity. He had practically already ordered the heat pump when we signaled to him with a handshake that we wanted to build with him. That was weeks before signing. Otherwise, he also buys more building materials in stock which he would have simply bought during the construction phase before. And he said the rest was his entrepreneurial risk, the rising prices had been foreseeable and he had calculated accordingly. This is an excerpt from our contract:

I don’t think anyone wants a legal dispute. That’s why I’d rather leave it to tomorrow’s phone call.

That’s a reasonable clause. Not such nonsense like with me… If I ever build again (which I don’t hope for), I will pay more attention to things like this.

Of course, he has to disclose something.... Strange answer, I would politely(!) decline the additional costs. Don't threaten, don't be angry, a legal dispute doesn't help anyone. However, based on your answers here, I would pay zero cents more.

I was also positively surprised when I saw the first contract draft. I believe that doesn't happen that often anymore today; he also emphasized several times during the preliminary discussions that when he says fixed price, he really means fixed price.
But you can also manage with less explicit passages; with a time limitation, I would be cautious though. But it's pointless to argue over spilled eggs afterwards.

I think in the end, both sides in your case are interested in an amicable agreement. You can build a solution on that foundation.

But then don't be surprised if nothing (in words: zero) progresses at the house in the coming months. This does not count towards the construction time guarantee, as the client has not settled an issued invoice.
