Here it says for medium and large garages...
According to the definition, however, we have a small garage (< 100m² usable area).

Accordingly, (2) would apply:


    [*]for closed small garages including storage rooms with no more than 20 m² floor area, at least fire-retardant or non-combustible partition walls without openings.

Our floor area is, however, 5.85 x 8.94 = 52m².

And literally, the letter from the Building Regulatory Office states:

According to §10 of the Brandenburg Garage and Parking Space Ordinance, for closed small garages including storage rooms with no more than 20 m² floor area, instead of fire walls according to § 26 (2) no. 1-3 BbgBO at the property boundary, at least fire-retardant or non-combustible partition walls without openings are sufficient.
The planned garage with a floor area of more than 20m² in steel element construction is therefore not permitted at the property boundary.

How is one supposed to fit [including storage room] into 20m² garage? The standard garage is already 3x6m = 18m². The 20m² can logically only refer to the storage room and not to the garage including storage room. In my opinion, the processor cannot read or interpret their own bureaucratic language.

The error might actually lie in the details! Especially since, according to the definition, a small garage has a usable area of <100m² and then it states in §:


    [*] closed small garages including storage rooms with no more than 20 m2 floor area

That really wouldn’t make any sense!

Then the 20m² probably really only refers to the storage rooms and here we have 3x6 = 18m – so everything is fine.
Accordingly, a fire-resistant or made of non-combustible building materials partition wall without openings is sufficient, which our steel prefabricated garage fulfills.

Right?

In my opinion, yes. But I am only an amateur. According to the editor's interpretation, otherwise every standard concrete garage with an extension (3x9m) would also have to be prohibited as boundary construction.
