So it would be possible that the existing windows are legal after all. IMHO, however, the neighbor bears the burden of proof.
The windows that existed back then were two per floor on the left and right in the gable wall. Now there are two windows centered one above the other. Once on the 3rd floor and once in the roof. The window in the roof is apparently even between the 4th and 5th floor (roof and attic). These apartments were converted into maisonette apartments in 2002. And at the earliest at that time were these windows installed. Just because there were windows somewhere there in 1902, it certainly does not mean it is allowed to put others in somewhere else?! But I am in the process of contacting the owner.
The unclear legal situation regarding the window openings in the party wall could convince the neighbor to buy you the strip of land with your old building and then tear it down. You would have to be good at negotiating ...
... which we actually do not want. The house is built exactly on the property boundary with 2 floors. It therefore takes up hardly any space from the property and already offers about 160 sqm of usable space. With a small extension, it could be brought to almost 180 sqm of living space and an additional 25 sqm of usable space. A carport on the property boundary to the parking lot (possibly even walkable) would also be conceivable.
In addition, there are the poor ground values in the new construction area and the fact that building lines must be observed in both street directions. With a new building, we would therefore have a house in the middle of the property with 3m, 6m and twice 6-10m distance to two times street, parking lot and sealed surface (if you opened these up, another 8m could be gained here. But a 15*20m garden was actually not our goal)
For the building application you need an official survey anyway, so you might as well commission it right away, no need to guess so much.
OK. As said, it is already planned and an offer is currently being obtained.
