What comes to my mind now, the editor writes: the garage is not permitted on the property boundary. He meant that if it stands on the property, it would not be a problem. But since it stands on the boundary, it requires a fire wall ... at least on the one side that stands on the boundary. However, the § above refers to an end wall and not necessarily to a boundary wall or similar.

For a garage with a distance >2.50m from the boundary, §26 BbgBO does not apply and you would not need a firewall anyway.



§10(1) No. 2 Garagenverordnung overrides § 26 para. 2 Nos. 1 to 3 BbgBO, i.e. all regulations for boundary walls and external fire walls and only refers to end walls. In my opinion, every boundary wall is an end wall, but not every end wall is a boundary wall.

Again: What speaks against a precast concrete garage? Problem solved.

Arguments against this are:

- that I have already ordered the garage
- I have inspected the garage with other builders and am convinced of it (steel prefabricated garage)
- a precast concrete garage is more expensive
- I have no desire for a joint "garage project" with the neighbor because I don't really know him yet
- I (still) do not see any reason to redesign half of my construction project just because an official interprets the laws as he pleases....

Why should the problem be solved? Even a concrete garage does not correspond to a fire protection wall. The problem of the "processor" is not the type of garage, but the size of the garage.

According to a retired lawyer friend, this means:


    [*]for enclosed small garages including storage rooms with no more than 20 m2 floor area, at least fire-retardant or non-combustible partition walls without openings.

the floor area of garage AND storage room is apparently meant.

Thus, § 10 (1) No. 2 BbgGStV would not apply to us, and therefore a fire wall is required !! :-(

Would the requirements be met for a garage (same size) made of reinforced concrete?
I don’t understand!
Everyone has their garage on the property boundary, and I don’t see any extra large or thick fire walls anywhere....
