We are also in Bavaria and our architect said that he does not believe in a faster processing in our district due to the new regulation. Due to staff shortages at the LRA and a flood of applications, the strategy of the last 2 years has already been to submit (unnecessary) inquiries 6 months after the application was submitted, i.e. at the previous deadline, thus restarting the deadline. This is unlikely to change in the near future.

That is dangerous half-knowledge! The change of the building permit here in Bavaria is called approval fiction and proceeds, as far as I know, as follows: 1. Submission of the building application 2. The building authority checks the documents for completeness. 3.1. If these are complete, a three-month deadline begins. If this expires, the construction project is automatically approved. 3.2. If these are incomplete, the building authority requests the submission of additional documents. This period has a suspensive effect. The deadline only begins when the application is completely complete. 4. After completeness/verifiability, the three-month deadline begins. The construction project is then automatically approved.

A short personal practical example: Our building application was submitted to the building authority at the end of August. The building authority asked us to submit six incomplete/unclear points. We complied through the architect. The building authority then considered five points resolved, but the sixth still faulty. I then asked the architect to call there directly. It turned out that the building authority itself (oh dear!) had made a mistake. I was informed that our building application is complete and the "fiction date" of the first revision (sometime at the end of September) counts. Our building application would thus be automatically approved on xx.12.2021. A decision will then be issued here.

I’m happy for you if you had a different experience. Unfortunately, with us it happened that after the first 6 months, reasonable inquiries were made, which the architect promptly complied with. After the second 6 months and repeated inquiries from our side, an obviously far-fetched and unnecessary addition to the plans was demanded, for which, on top of everything, the neighbor signatures had to be obtained again, even though the building had not changed by a single millimeter. Only the marked distance areas are now in a different color. No joke.

It remains to be hoped that the approval fiction will be handled differently in the future. I have only expressed here the skepticism of an architect who has never experienced such a request as we did.
