Maybe everyone should just take a deep breath.

Jana, your thread is chaotic and exhausting. One has to state it like that.

I'm still trying to grasp the problems as a whole, despite all the text written up to this point. I'm not an expert either. That's why I'm asking questions.

The patience of the expert present is obviously wearing thin.

I couldn't represent the slope like that in the program....as I planned, it would go down 2m immediately behind the stairs in the north view of the image.....

"Isn't that supposed to be the favored south terrace? Where is the shadow coming from? Something is wrong here!?"

As I said, I am a layman with the 3D program

"The info has passed me by so far in the course of the discussion. I find the information inconveniently spread out over many posts."

Yes, because the post was actually never about discussing how best to position a house on this plot......my initial question was whether/how I could get a deviation. During the discussion here, more and more questions arose and with them answers, that's why it is so spread out here

"No. YOU are supposed to plan according to the development plan. If the development plan never allows you a pleasing design, you bought in the wrong area - sorry to say so."
I see it differently, as written above. At the time of purchase, these problems were also not apparent due to the misleading formulations in the development plan. And one doesn't just refuse to get a plot here; you can also refuse a lottery win but you don't have to.....

"To summarize again: Your main concern is that the neighbors will build in the back in the north, fill in upfront, and then you will be trapped by retaining walls if you build in the south in front?"

That would be my concern regarding Escroda's suggestion about the neighbors to the west.

I think the topic is just too complicated to make clear.

The 3D plan shows what I would like to have but am not allowed, since I have to keep much more distance to the back. That’s why we have now rotated the garage in the ridge direction and planned the house 2 m further forward to the street....

Because of a North sun not deactivated in a drawing program?

Well, some things in images only become clear if you “know” the thread’s text by heart.

Although it must be added, there have been an increasing number of development plans recently where the slope situations etc. reveal that the municipal council members are not aware of the topology with its consequences. Then adjustments are also appropriate. Nevertheless, I think with Rhenish composure one could build something nice even without changing the development plan.

A concern - which I admit - is understandable.

Maybe with a plan illuminating several neighboring plots with various elevation markers, and quite classic photos of the landscape?

Dear Jana, the problem is that exceptions/exemptions are not just granted easily. They are rather the exception (ha!). In addition, your timing is bad since the development plan is currently being worked on anyway (you can try your luck, but more than rejection is not possible). Furthermore, you want to start building at the next ray of sunshine. All in all, your wish is unrealistic. The digressive discussion can then be positively framed as a search for possible workarounds. In addition, the planned development does not seem entirely coherent. And to say it once more: houses are planned to fit the plot and with the goal of obtaining approval. If the plot is fixed, you will have to be flexible elsewhere.

Or because of my paranoia. Let me summarize: First, improvement suggestions are rejected with the disclosure of ever new information, and just at the moment when it becomes clear how the property actually looks and all helpers give tips that are not in the interest of the OP, a sock puppet (no insult!) appears, who supports the OP with content-empty theses and makes the whole discussion start all over again. And when I then have to read in #97 after many attempts to explain and quotes of legal texts then the "troll" is the most plausible explanation for me. If you are not a troll, which by the way is not an insult (see Wikipedia), you should, after the meeting with the authorities next week, if no solution is in sight, open a new thread with location plan1 (rejected by the municipality), location plan2 (rejected by the district office), excerpt from the development plan and complete textual determinations, your "must-haves" and a priority list of all other wishes.
