Development plan unclear regarding the number of floors and height on the slope

Hello everyone,

we would like to buy a plot of land and build on it. It is a slight slope (on average about 10%, with the first 3 meters steeper than the rest). We want to build a bungalow with a slab-on-grade foundation. Now we would like to avoid excavating the plot extensively, but rather simply level it at the top and place the bungalow on it, so that the floor (or the slab) of the house, I estimate, will be about 2 meters above the street.

The development plan specifies different building heights (a bungalow is possible, and there is already one next door), but there is a paragraph stating something about a maximum height of the floor above the street level.

At a consultation appointment (construction company), we were told yesterday that this rule only applies to building with a basement, because it is only listed there (left column) in the drawing. However, I do not see this restriction in the text itself.

We would very much appreciate an assessment of how this paragraph should be interpreted. Are we allowed to place our bungalow 2m above the street edge?

I would initially also read that you cannot raise the bungalow by 2m. It is quite clearly stated there, "the floor adjacent to the street." Without a basement, that is your ground floor. But sometimes a preliminary building inquiry is worthwhile for something like this. Usually, you just want to avoid builders constructing towers on their property that then tower above all the other houses because of the view on the slope. But with a bungalow, that is not the issue.

To assess this, one should know the development plan and be aware of the building boundaries. Are you building uphill?

I would definitely plan that very carefully in advance with a site plan and the possible surroundings. Adding 2 meters of fill is not without its challenges either.

I would reserve the property and then thoroughly check the developability.

Show a picture of the property and the bungalow next door.

I see it the same way. I also believe that with a 2m embankment you will most likely achieve a Pyrrhic victory because you have to brace everything. How far should the house be from the street? To me, this sounds like a classic hillside house with a partially embedded basement.

Even if a bungalow would work, you should always build the houses with the land and not against the land. So use the slope and make the best of it (UG Technik, Schlafen, Hobbyräume and EG Wohnen/Essen/Kochen). Because of the slope, you also have a lot of light and large windows in the UG. I warn against building against the land and then constructing a bungalow that is set 2 meters higher, because you then have to support it for ages with masses of L-stones (10m lost in the garden) in order to eventually have the natural land gradient again. Not only does that look ridiculous, but it probably also costs 50k-100k.. Better to use the basement in the slope as a living basement right from the start.
