Yes, you laugh... Wait until you have to take your ancient Mercedes to a workshop where the last senior journeyman just retired and no one knows the technology from the 80s anymore. You won’t find it very funny either when they recommend an expensive repair or even scrapping it, when actually two screwdriver moves would have sufficed ;) When it comes to what architects calculate, you can expect 100%. Period.

Hello,

the garage itself does not trigger setback areas, as it is privileged. This has already been correctly addressed in the topic. Setback areas are generally triggered at a 90-degree angle, which I think is also clear.

In the present case, the architect is right. She is worth her money because this fact actually probably goes unnoticed by most people.

Reasoning:
The garage has a wall length on the boundary of 9.56 m - 1.24 m + x. The "x" results from the slope; the plan only specifies the length at the right angle, and the distance between the upper and lower corner is missing, so I cannot calculate the exact length.

According to the building code, 15 m of total boundary construction and 9 m per boundary are allowed. Since at least 8.32 m of the permissible length is already used by the actual garage wall, the setback area triggered by the front side (cf. 90 degrees to the wall) now exceeds the permissible 9 m.

I would also submit it and be happy about the approval. Probably no one at the approval authority will notice.

Hello,

just as a helpful addition to the above explanation:

If you look at the boundary wall from the neighboring property at exactly a 90-degree angle, you will still see part of the gate-side wall. This part is added to the 9 m (or 8.32 m + x). But only as far as this part is not itself 3 m away.

Hello,

I did not express myself clearly. The garage does not have its own setback areas, but it has a size limitation for this privilege. If the garage becomes larger, it triggers setback areas.



If the green wall length adjacent to the boundary already reaches the maximum of 9 m, then the permissible length of the boundary construction is exceeded (red). Because from the neighbor’s perspective, the wall is longer than 9 m by the width of the red wedge), part of the wall does not run exactly on the boundary.

Thank you for the explanation and the sketch, it becomes clearer to me. I will measure the actual length of the wall again. Perhaps it would be enough to shorten the garage by the width of the wedge. On the other hand, our garage driveway is also minimally disadvantaged, as the angle of the boundary creates an almost useless area.
