It was roughly the same problem for us. In the end, it resulted in a large retention (a moderate five-figure amount) and an extension of the warranty with a security bond being agreed upon.

Because why should I bear the risk of damage that should actually have been prevented by construction measures?!
And creating a white tank is more expensive than creating a black tank. So why pay more?

It’s best to discuss with your expert to what extent he also considers the tightness of the basement shell to be permanently guaranteed and decide together on the next steps.

Please keep us updated! And keep one thing in mind: defects in the basement (foundation of the house) are usually associated with the highest renovation costs/effort. You can't just quickly apply a new seal in passing.

Hi, sorry, it’s very stressful for me at the moment, not only because of the construction, so please don’t be mad if I don’t get in touch regularly or if it takes longer. First of all: many thanks to you. Update: The areas have now been sealed over a large surface. We have moved the vapor barrier “to the side” everywhere in the basement, together with the site manager and the employee of the “basement company”, so that we can currently check if anything is wet or getting wet somewhere. We then “walked through” the basement together. The site manager as well as the company employee will check again “if everything is okay”, the site manager of course more often, since he is regularly on site. The underfloor heating will be installed in a few weeks, depending on the schedule. Until then, check, check, check. Currently it is raining a lot and water is standing “at the house” in some places, so at least there a small “stress test” is taking place. That’s it regarding the elimination of the damp spots. As the next step, we will first draft a letter and see “what happens”. The basement has now been sealed several times. It is obvious that this was not done properly, so it is a matter of time before it has to be sealed again. Within the first 5-10 years “not so bad”, since theoretically there is a warranty (but that’s always a tricky thing…), but I would save myself all the dirt and so on. I would actually prefer a warranty extension (+ security bond) as suggested above, ideally in connection with a reduction. However, I currently have no energy for a court case... We will see what happens.

Thank you for the update. A court case is not necessary, that is true. But as you have already correctly recognized, you will in the future bear the risk of damage occurring, and the constructed building (the basement) does not correspond to the contractually owed quality if the construction company actually did it that way and it was not built according to [a.R.d.T.].

I don’t know which expert you commissioned, but discuss with him concretely and go through the criteria catalog for the market reduction in value.

The warranty extension to 10, possibly even 15 years, with a security guarantee for the basement must be demanded anyway.

Hello,

excavate and make a black tank out of it, including drainage using drain pipes, etc. Only in this way can water ingress be effectively prevented, as it is to be assumed that the concrete is not watertight at any point.
