Who has to pay the demolition costs for container construction?

But I mentioned the illegal construction in my original post. Now I googled "Schwarzbau" again and found the following:

"If an authority orders the demolition of an illegal construction, of course costs will arise. These costs must be borne by the property owner. In addition, a fine may be imposed. There is no uniform penalty catalog; the amount of the fine varies in each federal state and sometimes differs significantly."

This text again states that the property owner is responsible. And in this case, that is a third party (very likely). But this probably assumes a real estate property. We said that this does not apply to a movable container; the person who erected the container must demolish it.

Furthermore, according to this passage, a high fine is to be expected. Oh dear. How can someone be so stupid. Selling father's property and then something like this. That hurts...

In the picture, you can see 8 containers. They can be sold. 45k demolition cost is totally off. Listing on ebay and the thing is gone. If the demolition order is followed, the fine should be rather low.

The property owner must have made a contract after all. That is a proper structure. I wouldn’t just let this container castle be placed on the property. Someone is paying rent for that.

In our municipality, you are allowed to erect something like that. However, only with a temporary permit. As a construction company, we also set up our construction site cabins and were allowed to leave them standing for 10 years. Even a one-time extension was possible. But leaving them standing permanently is definitely not allowed.

All important notes. Thank you very much. However, I would actually expect such naivety from the property owner. The background is that this is the ex-partner of the aunt, and we know from a reliable source that this lady has often borrowed large sums from various friends as well as family members and has not repaid them. She possesses manipulative abilities. Unfortunately, I fear I will not be able to access the lease agreement, if there is one. Or at least I wouldn’t know how.

Do you have a rough idea of what the containers might be worth? Just a rough estimate

Plot, private green area with unauthorized container construction, plot size: 300 sqm of which approx. 120 sqm concrete support (thus approx. 180 sqm x €2.20) The lawyer has assigned a value of €500 for this item in the assets, which also seems very low to me. But I am a complete layman.
