Purchase contracts from developers are always without sales tax. (Exceptions are only possible when the buyer is an entrepreneur)

My personal opinion:
As a builder, you should definitely know when dealing with these sums whether you are buying a house with land from a developer or whether you yourself are the builder and having a house constructed on your own land through a general contractor/-entrepreneur under a contract for work.

I assume that your "personal opinion" is not referring to me. Since I know exactly that we are purchasing our semi-detached house from the developer. Since this is of course a private transaction, my assumption was that the clause in the purchase contract might rather refer to the VAT and was simply "confused". If not, I would assume that the clause also applies to the VAT?!

Our Value Added Tax Act is based on the system of multi-stage net turnover tax with input tax deduction, which means that only the added value within the company is taxed. The term value added tax is still commonly used, although the law always refers to turnover tax and input tax, not value added tax. In this respect, yes, it is the same. If you really purchase from the property developer, this is a tax-exempt service according to §4 No. 9a USTG. The clause in the contract is therefore completely nonsensical. For you, the timing of the installment or the completion of the house is entirely irrelevant, since no turnover tax has to be shown or paid anyway. If any is shown nevertheless, I would request a refund.

You are of course 100% right. Property developer contract and nothing to do with VAT... I also don't know how I let myself get on this horse after reading the last 11 pages... probably because in places it was mistakenly written property developer contract instead of general contractor...

Too bad, but good luck to all those lucky ones saving on taxes. We at least save on the kitchen, garden, and so on.

presumably copy and paste error. Your developer (WB, correct?) is acting as the general contractor for us since we bought the land separately and therefore have a general contractor contract with WB for the construction on our land.

What about contracts for work where the order has already been placed, but the final acceptance only takes place in the second half of the year, such as tiling, sanitary, or electrical work? Would the lower VAT rate also apply retroactively here?
