In the older Bavarian development plans, you can often see which plot belongs to Mayr Franz and which to Huber Josef, so whether the neighbor is really a "different party" legally speaking ;-)

I understood it to mean that has two adjacent plots and wants to build on one of them. So the neighboring plot also belongs to him, and behind that comes Franz Josef Mayrhuber. The question was whether Franz Josef is also consulted if Pitiglianio’s own undeveloped plot acts as a kind of buffer zone in between.

However, I wouldn’t care because I would have already invited Franz Josef for a beer anyway and would inform or ask him even without necessity. Unless the buffer plot is as big as Texas. Then it probably doesn’t matter at all.

In fact, the parcels to the south, west, and north are also in our possession. And to the east is the road, which then separates us from the next neighbor. The thing about the possible building encumbrance, which would then be queried with me personally, makes sense. Since we would of course like to have a decision on the building application as soon as possible, would it then be advisable to address this issue in advance, or would that not help timewise?

In Bavaria, there is no register of building encumbrances. Therefore, a transfer of setback areas must be entered in the land register. It is probably difficult to "fudge" a notary appointment with all parties involved.

The neighbors' signature serves to avoid the disclosure period (in our case, including notification, it would have been a total of 6 weeks back then). We also went to 7 neighbors because on one side, a path with 5 owners (terraced houses) borders our property. Fortunately, one of the neighbors was an architect who explained to the others that this was not about anything "impermissible," but only about the passage of time. That way, even the critical neighbors signed (we also personally visited each one with a box of chocolates :-) ).
