Positioning of the house on a north plot

That would of course be nice. And yes, in fact the building in the west is anything but set back 5m. Also to the southeast, only that one house is exactly on this line, the next house is about 10m offset to the back.

Maybe there is someone here who is familiar with such borderline cases and might have an opinion on it.

I just thought of another idea. Is it possible, since these are two plots of land, to shift the boundaries through a new survey? And how much would such a thing roughly cost? Can anyone say something about that?

Yes. §19 Building Code and §7 Saxon Building Regulations must be observed.

From approximately €3000; the first hit on my search engine for "teilungsvermessung sachsen" provides very good further information.

then probably no division is possible, because we would circumvent the building line with it. Or am I misunderstanding that?! But a shift, so that one property becomes larger and the other smaller, should still be possible, right?

I already suspected that this is still your goal, which is why I mentioned the §§. However, if you do not stick to your plan from #1, you can draw the new boundary so that a reasonably buildable plot of land remains. That way, the division would not contradict the regulations. Nobody has to know now that you do not intend to ever build on that property. Well, according to §176 of the Building Code, the municipality could impose a building obligation, but I consider that very unlikely. Before you start to be tricky, you should ask the approval authority what this completely nonsensical building line is all about. Or you ask your authorized design drafter what they think of your plans and whether a building inquiry might be advisable.

have already made contact and hope for timely insights. If necessary, the construction line may not be that decisive, at least that was the impression. So it came through that we already have a chance there. That would of course be nice.
