The plot is currently not developed, as it is a new development area. An application for development has already been submitted by the plot seller, but it was rejected by the building authority with the reasoning that a building application must be submitted before the development can be carried out.
Okal Haus, however, refuses to submit a building application and demands that the plot must be developed before the building application is submitted.
What we cannot do for you here is: look into your contract to see what was agreed there. For example, who submits the building application and when (i.e. under which conditions). So you have to read (yourself) what you signed.
Developing individual plots would be absolutely unusual; a development plan area usually does not have more than two construction phases, even if it has, for example, four types of building plots. However, many municipalities "collect" a certain quota of plot owners willing to build before they initiate development. Nothing happens quickly here; planning is done in fiscal years. Is your plot located in the "second row," so that accessibility might need clarification? – The mayor of Schilda (where built) even came up with the brilliant idea of surface-mounted development; such a mischievous trick has to occur to one first, although the shame threshold regarding this has shifted in recent years. Discuss the problem with a specialist lawyer (not a "general practitioner" or divorce lawyer!).
