Hello, regarding 1.) The plot that was mediated to us by Okal Haus and which we bought is a new development area. After consulting with the building authority, it is located within a development plan. regarding 2.) No. regarding 3.) I don't understand the question, what do you mean by "... developed (infrastructure)"? According to Okal Haus, they cannot submit a building application as long as the plot is not developed. After consulting with the building authority, this statement would be nonsense, as the plot is developed as soon as a building application is submitted. regarding 4.) After a conversation with the Okal Haus architect, he orally confided in me that Okal Haus likes to leave the home builders out in the cold so that the 15-month price guarantee is exceeded and Okal Haus can charge the customer even more.

Get a consultation appointment with a specialist lawyer. Based on your previous information, it seems you yourselves are not knowledgeable enough in the field of house construction.

well, the issue with the commitment interest is indeed "bitter". However, one question: you acquired the plot + (unfinished) house together from Okal Haus? That they still want to know from YOU how the plot can be reached by truck, etc., is absurd, isn’t it??!!

Was the financial broker also provided to you through Okal Haus or did you look for financing yourselves?

A lawyer would certainly not be wrong, they would check if all of this is really "legitimate". But that would again take (literally) valuable time.


Developed: street, electricity, water, sewer. For planning of pipe routes for supply and drainage. Maybe that does not fit into their concept to integrate you into the "company process flow" if there are these "unknowns".

What interest should Okal Haus have in keeping a customer waiting? They earn their money building the houses, not preventing it. Here seems to lie the crux of the matter. You are caught between the authority and the service provider, both demanding that the other makes the first move. Pragmatically, you resolve this situation – possibly with help. Whether that help has to be a lawyer is another question.

From whom did you buy the plot? From the municipality? Normally, they do the development for all plots in the new development area at once; it's more efficient and causes less trouble later.
Or did you buy it from a private seller who happened to have a plot that is now part of the new development area?
