Notary contract land inspection: should it be done or not?

What the "average Joe" considers developed does not necessarily have to be legally developed. Furthermore, there is a distinction in contribution law between the factual obligation to contribute and the personal one. It can sometimes take one to four years for this to be calculated by an authority. Therefore the question: Is there a redemption contract regarding the development costs? Or will there be a surprise bill for contributions in a few years according to §§127 ff of the Building Code?

Please explain that to me in more detail.

Which authority conducts soil surveys and how much does it cost approximately?

A geologist conducts such a survey. You should actually have it, the report of the entire new development area. It's not fundamentally important for you, but it's a reference point. You can also commission freelance geologists. The report is usually attached to the development plan if the new development area actually had to be newly developed and serviced.

These are standard contracts that apply to the entire construction area.

Noooo... the notary of the builder is the choice, so it is the notary's standard. So there may also be room for negotiation, but in what respect should there be room? Important are the framework conditions, and you can check those too: development plan, payment, building conditions, communal areas, construction road, finished road, height points, sewage, etc.

If you need security, have it checked. Otherwise, you can ask the notary about any passage until you understand it. It's part of their job. A real estate purchase agreement is really not rocket science. Some just get nervous because of the purchase price.

The whole thing is in Bavaria and the regional notary was selected by the municipality.

Noooo... it is the notary chosen by the builder who does it, and thus it follows the notary's standard.

So rather the municipality’s standard with its own notary. I don’t know it any other way either – a municipality usually doesn’t put itself through the hassle with every single notary for a new development area.

It was previously a field, but adjacent to it is already the first part of the development area that was created 5 years ago. Normal procedure, called the municipality and then got on a list of interested parties, and then when the plots were officially released I think I was one of the fastest to respond to the email. (It said responses are handled in order - sounded strange but it worked :) I already transferred the reservation fee 1 month ago and signed the reservation contract)

I personally think that is the fairest solution ... first come, first served .... but is that allowed under the stupid EU law?
