No disbursement of funding - Tax office is slow

Would you pay money for the construction of a house that does not yet belong to you (because [Erbpacht] is not yet settled)? Or do you pay a car dealer the price for a car and in return they do not hand over either the keys or the registration certificate? I wouldn't.

That's why I'm asking, we're just unsure how it all connects. We asked the notary if we can even start building on the property. He said: yes. That now also means that all 5 parties are building on a property on which they have zero rights, irrespective of the financing for now. It was also stated in the leasehold contract that we have been tenants since 1.8. and are already paying the rent for it, not much, but still. Am I seeing this correctly now: we pay for nothing, have nothing, and are allowed to do nothing?

As long as nothing is entered or at least registered in the land register, I would be cautious.

Although it always depends on who is on the other side. I would still consider churches and communities as guaranteed reliable sellers regarding the processing and likelihood of fraud.

Why do you already have to pay? Does the contract with the house manufacturer force you to make a current payment? Or would you just like to?

I know, being a party pooper is always unpleasant. But if there is currently no payment obligation, why fall into unnecessary stress?

I don't even remember how it was for us... we also leased, already paid the installments and waited for the construction to start. But for us, it didn't take as long with the tax office, so we didn't face any problems like you did. I have posted my advice - with us, the notary assistants already exchanged information with the bank to shorten the process. Regards Yvonne

Construction is supposed to start, as all the other parties are also pressing. At some point, commitment interest becomes due (with us partly since November already), etc. Of course, everyone wants to avoid the double burden. Since it is a joint construction project, it doesn’t depend on us alone, unfortunately *joking* : I saw your advice, thank you. On Monday we submitted another inquiry to the tax office; we will wait for their response.

I would personally speak with the tax office! Not every authority works the same way, but once a file is searched for and pulled up, it won’t be put aside again... at least that’s how it is with us! A written inquiry is answered with standard phrases, without even looking at the file.
