That doesn't matter. It has already been confirmed by one or more courts that the general contractor is always responsible for construction electricity. So it doesn't matter what is stated in the construction contract.

I pay for the construction electricity distributor, but if, for example, the thing is stolen and we don't get another one because the general contractor has none left, the general contractor is always liable since they are responsible for fulfilling the contract. I hope I have explained that correctly. :)

To be right, to get the right, and to enforce the right. Certainly, there is a certain internal logic that the builder has to take care of it because he needs it for the construction of the house. But that also applies to the later house connections, because construction power is usually not used for heating and "construction gas" doesn't exist at all.

In practice, you will hardly get away with that. Larger, nationwide construction companies have standard contracts, which are not changed for individual persons. And suing later takes a long time, the construction site is stalled, but costs continue to run. Hardly any client can afford that.

In the end, it also doesn't get cheaper if the builder provides the construction power. He charges for it, probably even significantly more than if you negotiate with the electrician yourself.

Can you name a few judgments?
I have often read here that construction power is the responsibility of the client.
Was that always illegal?

Maybe it depends on the nuances? I can imagine that it makes a difference whether a general contractor sells the total performance including the base slab and possibly earthworks, or whether he sells from top of the base slab like many prefabricated house manufacturers and the customer has a second contract for the base slab and earthworks, or even tenders the latter separately again

According to Oberlandesgerichts Schleswig, Urteil vom 31. August 2022, Az. 12 U 119/21 it is apparently always illegal when dealing with private consumers.

So a fairly recent judgment. When we requested offers, it was usually provided by the construction side.
