Yes, we will actually set it up so that it blows onto our property, but it is closer than 3m to the property boundary (hence the written consent). Otherwise, the neighbor is very well-disposed towards us...

However, when I read the post by hausnrplus25 now, I wonder whether this is sensible/necessary if only the noise emission is legally regulated or should be. I need to research this again for Schleswig-Holstein.

We also find different information. But we have noted that only 35 dB may arrive at a distance of 3m.

Limit values according to TA-Luft must be complied with. Which rooms are on your side at the neighbor's place.

At the property boundary, the neighbor has no living spaces, only his garage and a tool shed or a garden house.

Does that mean that I am responsible for both
1. obtaining a written consent for a location less than 3m from the property boundary
and
2. ensuring that 35db is not exceeded?

35dB applies according to TA-Lärm only at night, only in purely residential areas, and only for "rooms requiring protection". Specifically: in front of your neighbor's bedroom window, the heat pump must not produce more than 35dB noise emission at night. The garage is not a protected room according to TA-Lärm. Nevertheless, coordination with the neighbor is advisable if you blow cold air onto their property from a distance of 1m.

Regarding construction setback rules, 3m are only required if in a dispute a court classifies your heat pump as a "constructional facility." Such rulings have already been made with reference to the noise emissions of the heat pump. Reason: The heat pump causes disturbances to the neighbor similar to those that could also be caused by a constructional facility.
