During our earthworks, less was estimated beforehand than was actually needed. It was the same with the neighbors and also with the landscaping. Contractors often tend to estimate a smaller quantity in order to keep the bid price relatively low. But in the end, you will still have to pay for the actual quantity incurred, unless you can prove that digging was done unnecessarily too wide/deep.

Secondly, the contractor has not underestimated here, he is not responsible for the building ground surveyor's recommendation. And first of all, a contractor only has to estimate if the client does not tender with properly determined quantities.

If I understood the thread starter correctly, then the general contractor’s offer came after the geotechnical engineer’s recommendation. Nevertheless, I believe that certain deviations simply occur despite experience, as you write under point 3.

Or would you change your opinion if the offer was only made after the expert report was already available?

The "experience" is reflected here in the two tons that are supposed to make up one cubic meter once installed, and "deviations" arise in connection with the sorting (in which mixture the grain sizes are present). Deviations resulting from whether Stefan or Michael compacts today should remain far behind the decimal point. However: with an offer after the expert recommendation is available, the corresponding quantities should also be included in the offered amount.

That's exactly how it was. I requested an offer for the additional foundation which became necessary according to the geotechnical report. I then placed the order. NO ONE demanded digging deeper or wider. Apparently the subcontractor of the GU considered that necessary on his own, and now the GU is charging me for it. Therefore, the cubic meters calculated in the offer do not match the invoice because, according to the offer, the length and width of the pit are given as smaller. Incidentally, I did not provide the dimensions for the offer. The GU determined them himself.

In the meantime, he is even nicely recalculating this in a new invoice by changing the units from m³ to tons.

You have the choice how you approach it. Do you have photos and an explanation or do you (still) have to assume? My experience with civil engineering and soil reports with multiple drillings is that even the report does not provide absolute certainty – and cannot provide it, if you think about it. The soil conditions combined with a hillside location required a plan deviation to securely construct the foundations for our house. Although the additional costs were annoying, I am glad that the deviations could be plausibly explained to me and I was not contacted for every extra bucket of excavation or chisel operation. In the end, I received a clean and well-documented service that was billed correctly. Complex situation on several levels… This will be too tough for the excavator, this is what soil class 7 can look like The soil is chiselled massive rock, which the soil expert did not find, but did not rule out the possibility.
