Do you still have a retention of security with the construction company?

I will try that we split the amount, meaning that the construction company covers half and we cover the other half. Unfortunately, the boss has become such a conceited a**hole by now that he definitely won’t agree to that. :-(

No, we do not. The final invoice has been paid, with deductions for various defects. The contract also stated "no retention will be agreed upon".

Sounds like the construction company is not the most 'reliable'. Maybe you could team up with the electrician? Since the electrician has been trying to get his money from the construction company for a year, it seems as if he knows the oral agreement, namely that the construction company hired the electrician. If that is the case, I think as a layperson it will be difficult for the construction company not to fully cover the invoice if you enforce it together. Especially since your parents are also present as additional witnesses.

But who was commissioned? And with what? Perhaps the client has already paid for the service -- to his construction company. They do not pay the electrician, who is now trying after 2.5 years in another place.

Just a question: GC/CM/BT? How were other additional services commissioned, accepted, paid?

Do individual items appear on the electrician's invoice? Then you remove the relevant items, recalculate the total, and pay the man with the note that you did not commission the rest from him. If the electrician issues a flat-rate invoice, you reject it with the note that he can gladly break down his total.

The construction company commissioned him, as he was responsible for the entire electrical work. This only concerns the additional services, which he was not aware of. He installed the items because we discussed it on site when it came to distributing sockets and light switches. We were under the impression that the construction company had included everything in the lump sum price (unfortunately very naive).

The items are listed individually.
