Distance to the ring road - house and carport

Our property is the one in the middle; the northern house is located about 14m from the street. To the south, the house is set further back, but the shed/carport is attached about 11m from the street. The additional meter doesn't bother us, but on the left at the transition to the field, the ground slopes down, and the further we move away from the slope, the larger the garden becomes. If the house is located 15m away from the street, we have a 10m strip between the house and the property boundary along the street, which would of course be ideal for a carport.

Just a general question: is it really a question at all? After all, a carport is often exempt from a building permit anyway and can usually be built as a boundary structure? I’m not very familiar with this. But the requirement to insert [das Gebot zum Einfügen] generally concerns structures that require a permit, doesn’t it?

The building permit notice refers to the Lower Saxony Road Act:

§ 24 Structural facilities on roads

(1) Outside of through roads in towns, along state or district roads

1. above-ground buildings of any kind may not be constructed within a distance of up to 20 m, measured from the outer edge of the roadway designated for motor vehicle traffic,

Through roads in towns are not defined in terms of road construction law by the town entrance signs, as already mentioned above by . That is why, despite being "within built-up areas," we fall under this rule.

Our property is located within the town on a district road

That once again shows nicely that a picture is worth more than a thousand words: without the cadastral map, I would have imagined a plot accessed by the district road - not one located purely behind it.
