What you also have to check is whether it is an agricultural area. You are not allowed to buy that at all. Unless you have a registered agriculture.

According to the Land Property Transfer Act, the sale of agricultural land to non-farmers is indeed subject to approval pursuant to § 8 of the Land Property Transfer Act. However, according to § 9 of the Land Property Transfer Act, approval may only be refused in narrowly defined exceptional cases.

Yep, but not prohibited. In about 1/4 of sales, farmers exercise the right of first refusal. Denials of a sale have been legally tightened significantly – in favor of the buyer. It has now become difficult to prohibit the sale.
Apart from that, there are also exceptions depending on the federal state. I know it from NRW – there it is 10,000 sqm. Up to this size, purchases can be made without any approval requirements.

You are right, it is not forbidden, that was incorrectly expressed. However, the property cannot be sold directly (under the table). Since agriculture has a pre-emption right, it must also have been offered, otherwise a reversal can be claimed. However, a complaint must be filed for this (if no one is interested, you are lucky). Here in BW (very rural area), this is monitored very, very closely.

I have no idea right now where lives, but these are, to my knowledge, still the valid exemption limits up to which no permit is required. Since within these limits - as mentioned - no permit is issued and therefore cannot be denied, no right of first refusal can be exercised. This would only be possible after the permit is denied. In this respect, can simply buy the property. Regardless of whether it is agricultural land or not.
