Cost overrun in garage construction, what is the legal situation?

Have already confronted him with that. So far, I have only received the answer that the amount is based on a statistical value.

But if the architect plans a garage and estimates the costs for it, he cannot just rely on a statistical value of what a garage of that size on average costs. Rather, he must give the estimate specifically for this planned garage.

Which rights I have in this regard, however, I will probably not learn from the architect. That is why I turned to this forum.

Hello,

well, that is difficult. Do you have anything in writing? Or did the architect just mention a figure like that? How far had the planning progressed when the cost estimate was made? Were there already 1:100 scale plans with elevations, sections, etc.? Or just a rough sketch with approximate measurements?

I have the cost breakdown of the entire house in writing. The estimated costs of the garage are also listed here. At that time, there were plans at a scale of 1:100 with elevations. There certainly weren’t any plans with sections and details yet. But that shouldn’t matter.

is it really a cost estimate from the architect, as he has to carry out according to HOAI, or is it simply a list of costs to be deducted from the fixed price for own contributions?
That is a difference.
