Contract for work with completion guarantee?

Well, the account we set up with the construction sum is to be pledged to the BU, which we do not want. We want to pay according to the construction progress. But the BU wants to withdraw its money from this account.

Yvonne, of course I am also happy to wait 2-3 months longer if this is communicated to me from the beginning, and not only when the contract, which had to be "searched for," is presented to me and only made available after a lot of preliminary work. For me, contract management means a compromise between the contracting parties, and I really cannot see that at the moment. If even the lawyer advises against it ................ And this is not my first "farming experience," but it is my first with such contracts.

Pick another BU if you're already having such thoughts... pledging the construction account? Would a bank even agree to that? You are the contracting party after all...

These completion guarantees are market standard. No general contractor can predict the weather, which is why there are contractually specified circumstances that can extend the construction period. If the construction project is delayed outside of these circumstances, you are generally entitled to compensation of "x" euros/day. You can hardly expect more than that.


Correct. But that refers to completion guarantees or bonds and compensation per day or week, as I described.


A contract from a reputable provider is always balanced; they want – like you – to deliver a largely friction-free construction project. But it never runs completely without friction; it’s a question of how problems are handled!

If the contract you have is one-sided, you should change the provider! Furthermore, you should involve an independent expert for the construction project; they not only act as a mediator in case of stress but also have a calming effect on the homeowner’s gut feeling!


Any contract that does not violate good morals is legally valid by signature.



I’m almost certain I know who you want to build with.

Aside from the fact that a contract always involves two parties, I don’t understand why you are looking for solutions when your gut clearly says “No”? Other mothers also have beautiful daughters.

Well, it certainly wasn’t communicated to us from the beginning either, and as already mentioned, the start date of the construction was left open for us as well. But fortunately, we were not disappointed.

I don’t understand that a contract has to be searched for.

Are you sure you chose a general contractor you can trust? So: our expert, whom we only hired later (out of ignorance), would certainly have criticized several points of our contract. The installment payments for construction phases were also not realistically distributed... but sometimes you have to wear blinders, trust, and hope... even if others think everything should and can be done according to the owner’s nose ...

Then I would ask him which tree he probably lives on. That is not the right BU, so keep looking for one that is at least somewhat reputable.

For some posts, I’m not sure if that can be true, it is so far-fetched and the questions are so naive.
